Selling a Mortgaged Property in Dubai: Settlement, Release and Net Proceeds

You can sell a Dubai property that still has a mortgage. The balance must be settled and the mortgage released before the transfer. Here is how, with a worked example.

Yes, you can sell a mortgaged property in Dubai, but the outstanding loan balance must be settled and the mortgage released from the title deed before ownership can transfer to the buyer. In most sales the settlement is funded from the buyer's payment on transfer day. The early settlement charge your lender can apply is capped by Article 4 of the UAE Central Bank "Regulations Regarding Mortgage Loans" (Circular 31/2013): the actual break cost to the lender and/or the fees and charges set out in Regulations No. 29/2011.

Why the mortgage must be released first

Article 3.7 of the regulation requires a first-class mortgage in the lender's name on every financed property. That charge is registered against the title deed at the Dubai Land Department (DLD). A new owner cannot receive a clean title while the charge remains, so the sequence is always:

  1. settle what you owe the lender
  2. obtain the lender's release
  3. remove the mortgage at the DLD
  4. transfer ownership to the buyer

Step by step

1. Request a liability letter

Ask your lender for a letter showing the outstanding balance and any early settlement charge. Check the charge against the pre-payment policy and fee schedule in your contract (Article 4).

2. Agree the sale terms

Sign the sale agreement with the buyer. Make sure it states how the mortgage will be settled and who pays which costs. The 4% DLD transfer fee is usually paid by the buyer in practice, but the split is a matter of contract.

3. Fund the settlement

  • Cash buyer: the buyer typically pays part of the price to your lender to clear the loan, and the rest to you.
  • Buyer with a mortgage: the buyer's lender pays the agreed amount; your lender is settled from it.
  • Your own funds: you can also settle the balance yourself before the sale.

4. Release and transfer

Your lender issues the release documents, the mortgage is removed at the DLD, and the transfer to the buyer is completed. If the buyer has a mortgage, their new mortgage is registered at the same time, at 0.25% of their loan plus admin fees.

Early settlement rules to know

Article 4 protects you when you repay early because you sell:

  • the maximum charge is the actual break cost (for fixed loans) and/or the fees in Regulations No. 29/2011
  • the pre-payment policy must be clear in your contract
  • fees must be listed in a separate schedule
  • any fee change must be notified at least two months before it applies

Ask your lender for the exact figure that applies to you.

Worked example: net proceeds

You bought with a AED 1,200,000 loan over 25 years at an example rate of 4%. After 7 years, you sell for AED 1,800,000.

LineAmount
Sale priceAED 1,800,000
Outstanding balance after 7 yearsabout AED 974,172
Early settlement charge (illustrative figure; use your lender's)AED 10,000
Mortgage release feesas per the DLD and lender fee schedules
Net proceeds before release fees and any agent feeabout AED 815,828

The early settlement figure here is a placeholder for illustration only. Replace it with the amount in your liability letter. If you agreed to pay an agent's fee or any share of the transfer costs, deduct those too.

Selling an off-plan property with finance

If the property is still under construction and financed, the lender has disbursed funds against independently confirmed milestones (Article 2.1), and buyers' payments sit in the project's escrow account under Dubai Law No. 8 of 2007. Reselling before handover involves the developer as well as the lender, so ask both for their process and fees.

Tips for a smooth sale

  • Get the liability letter early; balances change with each payment.
  • Keep the release documents and DLD confirmation for your records.
  • If you plan to buy again, check the new loan with the affordability limits in Articles 3.1 to 3.4.

Buying again after the sale

The net proceeds can serve as the down payment for your next home. Article 2.4 allows this, because the money comes from your own resources rather than from borrowing. Before you commit to the next purchase, check:

  • whether the new property is a first home or an investment, since the maximum LTV changes (Article 3.2)
  • that the new loan passes the 50% DBR at the stressed rate (Article 3.1)
  • that you have budgeted the purchase costs again, including the 4% DLD fee and 0.25% mortgage registration

FAQ

Can I sell my property before the mortgage is paid off?

Yes. The outstanding balance is settled at or before transfer, and the mortgage is released so the buyer receives a clean title.

Who pays the early settlement fee when selling?

The borrower, unless the sale contract says otherwise. The amount is capped by Article 4.

Does the buyer need to know about my mortgage?

Yes. The mortgage is registered on the title deed, and the sale agreement should state how it will be cleared.

Can I transfer my mortgage to the new property?

That depends on your lender's products. Ask your lender; otherwise you settle and apply for a new loan.
